Terms and conditions of sale

These terms govern sales made by Wehbe Motors SARL, 3 rue du Talus, 67400 Illkirch-Graffenstaden, RCS Strasbourg 907 498 562. They draw a distinction between two regimes, because the law does: the sale of a used vehicle, concluded at the garage, and the sale of a spare part, concluded at a distance.

1. Sale of a used vehicle

Prices

Prices shown on the site are in euros. They include neither registration, nor the registration document, nor transport, nor any optional service. A price shown on the site is not a firm offer: it is an invitation to get in touch, and only the signed order form binds the parties.

Reservation and payment

A vehicle may be reserved by agreement between the parties. The sale is concluded at the garage, on signature of the order form, and the vehicle is handed over in person once the price has been paid in full. No vehicle payment is taken online.

No right of cancellation

As the sale is concluded on the garage’s premises and not at a distance, the fourteen-day right of cancellation provided for by Article L. 221-18 of the French Consumer Code does not apply.

Condition of the vehicle

Each listing states the vehicle’s condition, the mileage read from the odometer and the work carried out. A vehicle presented as accident-damaged, sold as seen, or reserved for the trade is flagged as such from the listing page onwards. Buyers are invited to inspect the vehicle and take a test drive before purchase.

Statutory warranty of conformity

A trader is bound by the statutory warranty of conformity (Articles L. 217-3 et seq. of the French Consumer Code) for twelve months from delivery for second-hand goods, as well as by the warranty against hidden defects (Articles 1641 et seq. of the French Civil Code). These warranties apply irrespective of any commercial warranty that may also be granted.

2. Distance sale of spare parts

Order and payment

Parts are sold online at the price shown in euros. Payment is made by PayPal. The order becomes firm only once payment is confirmed; an order number is then sent by email.

Collection and shipping

Parts may be collected at the garage free of charge, or shipped within France and the European Union for a flat fee based on the total weight of the order and shown before payment.

Right of cancellation

For parts bought at a distance, a consumer buyer has fourteen days from receipt to exercise their right of cancellation, without having to give a reason. Return costs are borne by the buyer. The part must be returned complete, unfitted and in its original packaging.

Availability

The stock shown is the garage’s stock at the moment you look. Should an ordered part prove unavailable, the order would be cancelled and refunded in full.

3. Common provisions

Complaints

Any complaint may be addressed to the garage by telephone on +33 6 19 30 65 37 or by post at the registered office address.

Consumer mediation

In accordance with Article L. 612-1 of the French Consumer Code, a consumer may refer a dispute free of charge to a consumer mediator with a view to reaching an amicable settlement. The contact details of the competent mediator are provided on request.

Governing law

These terms are governed by French law. Failing an amicable agreement, the French courts have jurisdiction.

Language of the contract

These terms are drawn up in French. Translations into German and English are made available for the reader’s convenience; in the event of any discrepancy, only the French version is binding.
